Frequently Asked Shariah & Financial Questions
What must be deducted from the deceased's property before distributing Wirasat? +
Under Islamic law (Surah An-Nisa 4:11), four steps are followed in strict order: (1) Funeral and burial expenses (Tajheez-o-Takfeen), (2) Payment of all outstanding debts including unpaid Wife's Mahr and loans, (3) Execution of a valid Will/Bequest (Wasiyyah) up to a maximum of 1/3rd of the remaining estate to non-heirs, and (4) Distribution of the net remainder among legal Quranic heirs.
Why are Brothers and Sisters excluded when a Son or Father is alive? +
By unanimous consensus (Ijma) of Islamic jurists under the rule of Hajb (Exclusion), the presence of a direct male descendant (Son) or direct male ascendant (Father) completely blocks Full Brothers and Sisters from inheriting.
What are 'Awl and Radd in Islamic Inheritance? +
'Awl occurs when the sum of fixed Quranic fractions exceeds 100% (1.0); all shares are proportionally reduced so every fixed heir receives their fair ratio. Radd occurs when fixed fractions add up to less than 100% and there is no residuary heir (Asabah); the surplus is proportionally returned to the non-spouse blood heirs.
